hereinafter known together as the "Sponsor".

PROMOTION DESCRIPTION: The Patriot Subaru "Win A 2019 Subaru" (the "Sweepstakes") begins December 26, 2018 and ends on February 13, 2019. (the "Promotion Period"). The random drawing will be conducted by the Sponsor on February 14, 2019.  Entry in the Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor shall be final and binding in all respects.

ELIGIBILITY: Only legal U.S. residents who are eighteen (18) years of age, and are legal residents of either Maine, New Hampshire, Massachusetts, Rhode Island, and Connecticut are eligible to enter.   Sponsor, or any other media partner who is involved in the promotion or advertising of the Sweepstakes, and each of their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (collectively, the "Promotion Entities") and the immediate family members, and/or those living in the same household of each, are ineligible to enter the Sweepstakes or win a prize.

HOW TO ENTER: 

1.) AT THE STORES
a. Visit Patriot Subaru, located at 769 Portland Road, Saco, Maine 04072 during business store hours, during the "Promotion Period", and fill out an entry form. Business store hours are as follows: Monday through Thursday 8am to 8pm, Friday and Saturday 8am to 6pm, closed Sunday.
b. Visit Patriot Subaru of North Attleboro, located at 551 S. Washington Street, North Attleboro, MA 02760 during business store hours, during the "Promotion Period", and fill out an entry form. Business store hours are as follows: Monday through Thursday 8am to 8pm, Friday and Saturday 8am to 6pm, Sunday 11am-5pm.

Both stores will be closed on January 1, 2019 for the holiday.

On an official entry form or plain piece of paper, hand print in ink your full name, complete home address and zip code, cell phone, home telephone number and area code, and email address. Incomplete entries will be disqualified. No copies, facsimiles or mechanical reproductions will be accepted. Entries are accepted until the close of business on Tuesday, February 13th ,2019.   Individuals are allowed to visit both stores in-person, and may enter once at each store. Limit one (1) in-store entry per person.


2.) INTERNET (Website or Mobile Device)
Each store has a website. Individuals can enter on one site. There is a limit to one (1) INTERNET entry per person.

Follow the instructions to enter and submit your first name and last name, complete address, city, state, zip code, cell phone, home/office telephone number, and a valid email address in the online entry form.

Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Sponsor and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Sponsor. Sponsor's computer is the official time keeping device for the sweepstakes. Entries posted with a time after February 13, 2019 at 11:59pm are not eligible for the drawing. Sponsor is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.


3.) MAIL ALTERNATIVE OPTION
If you do not have access to a computer, cell phone, or internet in order to enter online, or you are physically unable to visit the store to register in-person, you may enter 1 time via regular postal mail. On a plain piece of paper, hand print your full name, home address and zip code, home telephone number, and mail it to:

Incomplete entries will be disqualified. No copies, facsimiles or mechanical reproductions will be accepted. Entries are accepted until the close of business on Tuesday, February 13th, 2019. Limit one (1) mailed entry per person. Sponsor is not responsible for entries not received due to unpredictable mailing delays, incorrect postage fees, incorrect addresses, weather, or entries lost or misplaced due to errors at the postal service.

ODDS OF WINNING: The odds of winning depend on the total number of eligible entries received.

WINNER SELECTION AND NOTIFICATION: At the end of the Promotion Period, the prize winner will be randomly selected from all eligible entries received at the store during the Promotion Period. The potential prize winner will be notified by telephone and/or mail and/or e-mail, using contact information provided or collected at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected.

PRIZE/RETAIL VALUE: One Prize is available: A 2019 Subaru with a Manufacturer's Suggested Retail Price (MSRP) not to exceed $30,000.  

a) The Prize Winner may select one new 2019 Subaru from the in-stock "on-the-ground" inventory available present at either Patriot Subaru in Saco, ME or Patriot Subaru in North Attleboro, MA on February 14th 2019, with an MSRP not to exceed $30,000. In marketing, it will be referred to as "Up to $30,000"

b)   If the vehicle selected by the Prize Winner has a MSRP less than $30,000, no cash or any other form of compensation or service will be provided by the Sponsor to bring the total up to $30,000.   By way of example:  If the Prize Winner selects a vehicle with a MSRP of $25,0000, the Prize Winner will not receive $5000 in additional compensation in any form. 

c)   MSRP is set by the Manufacturer, not the Sponsor. MSRP will vary from same model car to car depending on trim packages and installed options.  

d)    There is no cash substitute or alternative prize, and the Sponsor is under no obligation to offer any other option.

e)   The Prize Winner may not "order" or wait for additional inventory to arrive into the Sponsor's inventory.  Choice of vehicle, color, trim, options, accessories is limited to what is available on February 14th, 2019.

f)  Some Subaru models are naturally low in inventory. It is possible that a particular model may not be in inventory on February 14th, 2019.  A good example is the Subaru BRZ. This is beyond the control of the Sponsor, and thus a particular model may not be available as a choice of the Prize Winner. 

g)    The Prize Winner is allowed a 48 hour "Decision Period" from the time they are validated by the Sponsor as the Prize Winner to choose a Prize vehicle that meets the aforementioned standards. During this time they may look at, test drive, and evaluate different vehicles from the Sponsor's stores. 

h)   It is the responsibility of the Prize Winner to evaluate and consider any tax implications, insurance costs, and title and registration fees of the vehicle they select, as the amounts may vary. The Prize Winner is ultimately responsible for any applicable local, state or federal taxes levied, insurance costs, title and registration fees that arise with the acceptance of the Prize.
i) In accordance with the state laws of the winner, Patriot Subaru will collect the appropriate taxes and registration fees on behalf of the state from the Prize Winner.  They are to be paid by the Prize Winner at time of delivery. 

j)   During the 48 Hour "Decision Period" the Sponsor is under no obligation to "hold" or "reserve" any vehicle or vehicles for the Prize Winner while that decision is being made. The Prize Winner agrees and understands that if they are evaluating their choices of vehicles, and one that they are interested in is sold to another customer, the Prize Winner had no rights or entitlement to that vehicle, and must select another Prize.  

k)    In the event of weather, natural disaster or other act of God, or if the Prize Winner is unable to visit one of the stores within 48 hours of receiving notification of winning due to personal or family illness, or other such condition that makes visitation an undue hardship, the Prize Winner must submit a notarized letter that explains the delay. At the discretion of the Sponsor, an extension can be granted with regards to the inventory from which the Prize Winner can select their prize.

l) If the Prize Winner is unable to select a Prize within the 48 hours of notification, and does not supply the Sponsor with a notarized letter explaining the delay, or otherwise fails to satisfy the requirements set forth in these Official Rules, then at the discretion of the Sponsor, the Prize will be forfeited and awarded to an alternate winner selected at random from among the remaining eligible entries.

m)     The Prize is non-transferable. If the Prize Winner is unwilling or unable to take possession, they may not transfer it to a family member, friend or associate without the expressed written consent of the Sponsor.

GENERAL PRIZE CONDITIONS: Prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize, including title, vehicle insurance and registration fees. Prize winner must present a valid driver's license, evidence of insurance and any other information required by Sponsor in order to pick up the Prize.
The potential prize winner must execute an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, "Prize Claim Documents"). If winner fails or refuses to sign and return all Prize Claim Documents within three (3) days of prize notification (or a shorter time if required by exigencies), winner may be disqualified and an alternate winner may be selected.
Sponsor agrees to provide the prize winner with the applicable vehicle warranties as provided by Subaru, in addition to Sponsor's own Lifetime Warranty program as defined in writing.  Said program will be provided at no additional cost to the prize winner.

GENERAL LIABILITY RELEASE/FORCE MAJEURE: Acceptance of a prize constitutes prize winner's permission for Sponsor to use prize winner's name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Entrants agree that the Promotion Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants' acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize's quality or fitness for a particular purpose. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor's control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In the event Sponsor is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g., SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF MAINE AND MASSACHUSETTS WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS.

WINNER'S LIST/OFFICIAL RULES: Any legally required winner's list may be obtained by sending a self-addressed, stamped envelope to: Patriot Subaru Contest Winners, 769 Portland Road, Saco, Maine 04072. All such requests must be received within six (6) weeks after the end of the Promotion Period.
